Incident Involving the Cape Fear 38R, Cynthia Woods and the Texas A&M University At Galveston Sailing Team
Sat 7/10/08: CF38R Cynthia Woods
Cape Fear Yacht Works, LLC and Mr. Bruce Marek are and have been cooperating fully with all local, state and federal investigative authorities as the investigation into the capsizing of the Cynthia Woods continues. All requested plans, blueprints, and photos were provided to the United States Coast Guard for its investigation. At the appropriate time, Cape Fear Yacht Works, LLC and Mr. Marek will respond to the Stone family's request for this information in accordance with the Texas Rules of Civil Procedure. As the Stone family's attorneys communicated their intent to file suit prior to asking for this information, it was the appropriate and reasonable action to decide to wait for the lawsuit to be filed, so that all Texas procedural rules are followed in responding to their request.
Cape Fear Yacht Works, LLC and Mr. Marek are steadfast in their continued support of the design and build of the Cynthia Woods.

The accident at sea is still under investigation by the authorities and until the investigation is concluded, no purpose is served in speculating what may have happened.
Sat 6/21/08: CFYW Delivers Full Cooperation as Investigation of the Capsizing of the Cynthia Woods Continues
HOUSTON - As the investigation of the capsizing of the Cape Fear 38R Cynthia Woods continues, Cape Fear Yacht Works has pledged and is delivering its full cooperation with all local, state and federal investigative authorities. "First and foremost, our heartfelt condolences go out to Roger Stone's family, friends, colleagues and students, as well as the sailors saved by the heroic actions of Mr. Stone," said Rona Garm, manager and spokesperson for Cape Fear Yacht Works. Cape Fear Yacht Works is particularly focused on learning all of the details of the extensive repairs that were done after the multiple groundings as referenced by Texas A&M University at Galveston in its press conference on June 17 - specifically the severe grounding in March of 2007. During the company's multiple visits last week, extensive information, plans and photos of the Cynthia Woods and George Phydias build process was delivered to the United States Coast Guard for their investigation. The Cynthia Woods and George Phydias are two Cape Fear 38R sailboats that were specifically built to provide a sturdy, long-lived, vessel for Texas A&M University collegiate sailing programs. "Since the vessels were delivered to Texas A&M University in December of 2005, Cape Fear Yacht Works has not been involved in any of the post-delivery commissioning or repairs," said Garm. "It is inappropriate for us to speculate further as to potential causes of this tragedy. We prefer to wait for the final United States Coast Guard findings to determine the sequence of events that may have led to the loss of life last weekend." Bruce Marek, an experienced naval architect who is responsible for the Cynthia Woods' design, said the vessel's structure is not flawed. Marek said he uses the design of the boat, a Cape Fear 38, as a textbook example of a model design at industry seminars and when teaching naval architecture review courses. Founded in 2000, Cape Fear Yacht Works, based in Wilmington, North Carolina, has built a number of vessels by hand to the highest quality standards. The company believes in the design, build process, and safety of all its vessels. Cape Fear 38s have raced and cruised the East and Gulf coasts since 2001 with an exemplary safety record.

Sat 6/14/08: Cape Fear 38R "Cynthia Woods" Capsize
As many of you may have heard, the CF38R, Cynthia Woods sailboat and the Texas A&M University at Galveston off-shore sailing team were involved in a capsize incident June 8 during a race from Galveston, TX to Veracruz, MEX. We are all very saddened by this tragedy. Our heartfelt condolences go out to Roger Stone’s family, friends and associates. Our thoughts are focused on the sailors saved by the heroic actions of Mr. Stone and the United States Coast Guard Rescue Teams as we await their final findings. Since its inception in 2000, Cape Fear builds vessels by hand to the highest quality standards. We believe in the design, build process and safety of our vessels. This vessel was custom built by Cape Fear Yacht Works for Texas A&M University collegiate sailing. We have heard that the vessel has undergone repairs since built and donated in 2005. However, Cape Fear Yacht Works has not been involved in any post-delivery work. Cape Fear Yacht Works has pledged to deliver our full cooperation throughout the marine surveys and final resolution.

Since its inception in 2000, Cape Fear Yacht Works has built vessels by hand to the highest standards. We believe in the design, construction and safety of our vessels. This vessel was custom built by Cape Fear Yacht Works for Texas A&M University collegiate sailing. Since leaving the factory, all maintenance and repair work, if any, to the vessel would have been performed by the vessel owner, and not Cape Fear Yacht Works.
Cape Fear Yacht Works has pledged to deliver our full cooperation with all local, state and federal investigative authorities.
